Pursuant to Article 3 of the RA law on Legal regime of the state of emergency, the implementation of measure during a state of emergency cannot hinder the normal operation of the courts.
In spite of this provision the Supreme Judicial council adopted decisions instructing the courts to postpone all trials, except the cases to be examined immediately or to conduct the trials online using all available online applications.
Attorney Ashkhen Dashyan address this topic in her interview to “Hetq”, noting that a practice has been formed that if one of the parties submits a motion to postpone the trial, the courts grant the requests regardless of the stance of the other party.
